ACCC takes on heavy-handed Esanda

The Australian Competition and Consumer Commission is taking ANZ-owned finance company Esanda to court alleging overly aggressive debt-collection tactics, breaches of the Trade Practices Act and "unconscionable conduct". Proceedings were initiated in 2001 with the bank saying it has tried to reach an out-of-court settlement since then and has improved its procedures relating to the repossession of cars under finance.

The ACCC alleges that an Esanda customer was "subjected to physical force, undue harassment and coercion". Esanda allegedly visited the customer's spouse at work, restricted access to his home, charged unreasonable collection fees and failed to supply details of the amount in arrears.
